With the Elysium Garden Hotel Early Booking Cancellation and Refund Package application, guests are given the right to cancel their reservations at selected hotels without penalty under any circumstances. With this application, it is possible to cancel a reservation up to 72 hours before the start of the reservation. All you need to do is to have a cancellation guarantee at the time of making the reservation and have this right with a small extra fee.
In case of reservation cancellation, the entire accommodation fee is refunded, but the package fee is not refunded. The cancellation and refund package only covers hotel accommodation, and the flight tickets purchased with the reservation are not included in the package.
1. CANCELLATION DUE TO FORCE MAJEURE AND/OR MEDICAL ILLNESSES;
Force majeure cases stipulated in the laws for the consumer or first degree relatives, serious accidents that prevent the fulfillment of any of the provisions of the accommodation contract of the consumer, serious illnesses requiring treatment, death cases are considered force majeure cases for the CONSUMER. The consumer must prove the existence of force majeure with a valid document obtained from official institutions and state hospitals. In the event that the consumer gives written notice of termination less than 30 days before the start of the accommodation due to a situation that the consumer could not foresee and prevent despite showing all necessary care or the force majeure reasons specified in this article, the amount paid by the consumer will be returned to the consumer without any deductions, excluding expenses arising from legal obligations such as mandatory taxes, duties, etc. and non-refundable amounts paid to third parties that can be documented. According to Law No. 1618, if this cancellation is covered by insurance, the necessary refund will be made by the insurance company and the refund period varies depending on the insurance damage refund process time. Elysium Garden Hotel is responsible for the duration of the insurance refund process and the paperwork.
Elysium Garden Hotel reserves the right to partially or completely cancel reservations due to problems originating from the hotel, weather and road conditions, force majeure and/or similar reasons. This situation is notified to the Consumer at least 7 days before the accommodation date for international reservations, at least 2 days before the reservation date for domestic reservations, and 1 day before the accommodation date for reservations that will be made in the same week. Elysium Garden Hotel refunds the entire payment of the Consumer within 14 days in such cancellation cases. The Consumer has no right to claim compensation from Elysium Garden Hotel regarding this cancellation.
In case the services promised to the consumer during the accommodation cannot be provided to the consumer by victimizing the consumer, all responsibility belongs to the product provider. Elysium Garden Hotel is an intermediary here and has no responsibility or authority regarding the accommodation. In such a case, the compensation of the victimization of all consumers who make a purchase from Elysium Garden Hotel belongs to the product provider. Elysium Garden Hotel cannot be held responsible in any way, directly or indirectly.
For refunds made to credit cards, it may take up to 14 business days for the refund to be reflected on the card, depending on the working conditions of the banks. If the consumer requests a refund to their bank for an accommodation purchased with a credit card, Elysium Garden Hotel cancellation and refund terms apply. In accordance with the cancellation and refund terms accepted when purchasing the accommodation, they do not have the right to request a refund of the Credit Card payment from the bank. Credit card refund transactions can only be made by Elysium Garden Hotel.
