ELYSIUM GARDEN HOTEL ZİYARETÇİ KİŞİSEL VERİLERİNİN İŞLENMESİNE VE KORUNMASINA İLİŞKİN AYDINLATMA METNİ

6698 Sayılı Kişisel Verilerin Korunması Kanunu “Kanun” uyarınca, kişisel verileriniz; veri sorumlusu olarak Elysium Garden Hotel (“Elysium Garden veya Şirket”) tarafından aşağıda açıklanan kapsamda işlenebilecektir.

Kişisel Verilerin Hangi Amaçla İşleneceği
Toplanan kişisel verileriniz, Elysium Garden Hotel tarafından sunulan ürün ve hizmetlerden sizleri faydalandırmak için gerekli çalışmaların yapılması ve ilgili iş süreçlerinin yürütülmesi kapsamında aşağıdaki amaçlarla (“Amaçlar”) Kanun’un 5. ve 6. maddelerinde belirtilen kişisel veri işleme şartlarına uygun olarak Şirket tarafından işlenebilecektir:
– Aşağıda yer verilen Elysium Garden ürün ve hizmetlerinin (“Ürün ve Hizmet”) sunulması;

Elysium Garden restoran, pastane ve catering ürün ve hizmetlerinin sunulması,
Elysium Garden tarafından işletilen otelcilik hizmetlerinin sunulması ve bu kapsamda rezervasyon, giriş, konaklama gibi hizmetler ile talep edilmesi halinde SPA&Fitness hizmetlerinin sunulması,
Davet, etkinlik ve organizasyon hizmetlerinin sunulması,

– Ürün ve Hizmet sunumu için fiyat teklifi süreçlerinin gerçekleştirilmesi ve ödemelerin tahsili,
– Şirket tarafından sunulan Ürün ve Hizmet’ten ilgili kişileri faydalandırmak için gerekli çalışmaların iş birimleri tarafından yapılması ve ilgili iş süreçlerinin yürütülmesi,
– Şirket’in ve Şirket’le iş ilişkisi içerisinde olan ilgili kişilerin hukuki, teknik ve ticari-iş güvenliğinin temini,
– Resmi kurum taleplerinin yerine getirilmesi ve yetkili kuruluşlara mevzuattan kaynaklı bilgi verilmesi,
– Mevzuatta öngörülen saklama yükümlülüklerine uygunluğun sağlanması,
– İlgili kişi başvurularının mevzuata uygun olarak yanıtlanması ve gerekli işlemlerin gerçekleştirilmesi,
– İleride meydana gelmesi muhtemel olası uyuşmazlıklarda delil teşkil etmesi amacı ile kişisel verilerin genel zamanaşımı süresince saklanması,
– Şirket yerleşkeleri ve/veya tesislerinin güvenliğinin temini,
– Müşteri talep ve şikayetlerinin takibi ve yönetimi,
– Müşteri memnuniyeti çalışmalarının yürütülmesi,
– Hukuk işlerinin takibi ve yürütülmesi,
– Denetim / etik faaliyetlerinin yürütülmesi,
– Şirket faaliyetlerinin Şirket prosedürleri ve/veya ilgili mevzuata uygun olarak yürütülmesinin temini için gerekli operasyonel faaliyetlerinin yürütülmesi.

Açık Rızanızın Varlığı Halinde Kişisel Verileriniz Hangi Amaçla İşlenmektedir?
Toplanan kişisel verileriniz; Ürün ve Hizmetlerin pazarlama süreçlerinin planlanması ve icrası, profilleme ve analiz faaliyetlerinin yürütülmesi, Ürün ve Hizmetlerin beğeni, kullanım alışkanlıklarınız ve ihtiyaçlarınıza göre özelleştirerek sizlere önerilmesi ve tanıtılması, kabulünüz kapsamında paylaşmış olduğunuz iletişim bilgilerinize reklam, promosyon, vb. ticari elektronik ileti gönderilmesi ve gönderim sağlanması için hizmet aldığımız üçüncü kişilerle paylaşılması amaçlarıyla açık rızanız kapsamında işlenebilecektir.

Kimlik, iletişim ve müşteri işlem bilgileriniz verilerin barındırılması, pazarlama faaliyetlerinin ve müşteri memnuniyeti süreçlerinin yürütülmesi amacıyla yurt dışında mukim tedarikçimiz SAP AG. , Hotelrunner Inc, Review Rank S.A., Amazon Web Services EMEA, Oracle Systems Corporation ile paylaşılmaktadır.

Kişisel Veri Toplamanın Yöntemi ve Hukuki Sebebi
Kişisel verileriniz, Şirketimizin ürün ve hizmetlerinden yararlanmanız kapsamında Şirketimiz tarafından fiziki ortamda pastaneler, oteller, , restoranlar Elysium Garden tarafından işletilen davet ve etkinlik mekanları ile elektronik ortamda internet sitesi ve sosyal medya kanallarından bizimle temas kurduğunuz kanal üzerinden toplanmakta ve aşağıdaki hukuki sebeplerle işlenmektedir.

Bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması kaydıyla, sözleşmenin taraflarına ait kişisel verilerin işlenmesinin gerekli olması hukuki sebebine dayalı olarak;

Ürün ve Hizmet sunulması,

Ürün ve Hizmet sunumu için fiyat teklifi süreçlerinin gerçekleştirilmesi ve ödemelerin tahsili.

Şirket’in meşru menfaatleri için veri işlenmesinin zorunlu olmasına ilişkin hukuki sebebe dayalı olarak;

Müşteri memnuniyeti çalışmalarının yürütülmesi,
Hukuk işlerinin takibi ve yürütülmesi,

Şirket faaliyetlerinin Şirket prosedürleri ve/veya ilgili mevzuata uygun olarak yürütülmesinin temini için gerekli operasyonel faaliyetlerinin yürütülmesi.

Elde edilen kişisel verileriniz açık rıza vermeniz halinde;

Pazarlama süreçlerinin planlanması ve icrası ve profilleme ve analiz faaliyetlerinin yürütülmesi, ürün ve hizmetlerimizin beğeni ve kullanım alışkanlıklarınıza göre özelleştirilerek size sunulması ve tanıtılması amacıyla toplanmakta ve iş ortaklarımız ve tedarikçilerimiz ile paylaşılmaktadır.

İlgili Kişinin Kanun’un 11. Maddesinde Sayılan Hakları
İlgili kişi olarak Kanun’un 11. maddesi uyarınca aşağıdaki haklara sahip olduğunuzu bildiririz:

Kişisel verilerinizin işlenip işlenmediğini öğrenme,
Kişisel verileriniz işlenmişse buna ilişkin bilgi talep etme,
Kişisel verilerinizin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
Yurt içinde veya yurt dışında kişisel verilerinizin aktarıldığı üçüncü kişileri bilme,

Kanun ve ilgili diğer kanun hükümlerine uygun olarak işlenmiş olmasına rağmen, işlenmesini gerektiren sebeplerin ortadan kalkması halinde kişisel verilerinizin silinmesini veya yok edilmesini isteme ve bu kapsamda ve kişisel verilerinizin eksik veya yanlış işlenmiş olması halinde yapılan işlemlerin kişisel verilerinizin aktarıldığı üçüncü kişilere bildirilmesini isteme,
İşlenen verilerinizin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
Kişisel verilerinizin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması halinde zararın giderilmesini talep etme.

Talebinizin niteliğine göre en kısa sürede ve en geç otuz gün içinde başvurularınız ücretsiz olarak sonuçlandırılacaktır; ancak işlemin ayrıca bir maliyet gerektirmesi halinde Kişisel Verileri Koruma Kurulu tarafından belirlenecek tarifeye göre tarafınızdan ücret talep edilebilecektir.

Based on the legal reason of necessity to process personal data of the parties to a contract, provided that it is directly in connection with the conclusion of a contract or performance of a contractual obligation;

Based on the legal reason that it is is mandatory for the data controller to fulfill its legal obligation;
